Can I make a gym injury claim?

Gyms can be a very dangerous place if used incorrectly or not properly maintained. They often contain various types of equipment, machines and weights, all of which have the potential to cause serious injury.

It is therefore vitally important that the proper health and safety procedures are not only in place, but strictly implemented and maintained to minimise the risk to all gym users and staff. When procedures are overlooked, accidents are likely to happen.

Suffering an injury at the gym due to someone else’s negligence can be incredibly distressing and have a huge impact on your day-to-day life. It can leave you dealing with pain and discomfort and often means time out of work, potentially causing financial worries during your recovery.

No one should have to deal with the consequences of someone else’s negligence. If you’ve suffered an injury at the gym and you believe someone was to blame, you could be entitled to make a gym accident claim.

What are the most common types of accidents in the gym?

Some of the most common causes of accidents in the gym include:

  • Issues with the equipment and machines in the gym, due to lack of maintenance or incorrect assembly
  • A lack of safety training for staff members
  • Not providing a safety briefing during induction sessions for new gym members
  • A lack of appropriate safety measures and procedures to be implemented
  • General poor maintenance of facilities
  • Incorrect or dangerous advice being given by gym staff
  • Accidents around swimming pools, including slips, trips and falls

This is not an exhaustive list, and regardless of how your gym accident was caused, if you believe someone else’s negligence has caused you injury you could be entitled to make a claim for gym injury compensation.

What are the most common injuries at the gym?

As there are a range of potential hazards in gyms, the list of injuries that can be caused if safety is not prioritised is extensive. They can range from minor injuries such as cuts and bruises, to much more significant levels of damage.

Some of the most common types of injuries that result in a gym accident claim include:

  • Soft tissue damage, such as cuts, scrapes and bruises
  • Sprains to ankles or wrists
  • Ligament and tendon damage
  • Dislocations
  • Broken bones and fractures
  • Achilles injuries
  • Injuries to the back, shoulders or limbs
  • Head or brain injuries
  • Nerve damage

What should I do if I’ve been injured at the gym?

If you suffer an injury at the gym, the first thing you should do is seek medical attention. If your injury is relatively minor, the gym staff should provide first aid assistance, though it is advisable to make an appointment to see your GP as soon as possible.

If your injury is more severe, you should attend your local hospital’s A&E department or phone 999 for an ambulance.

Who is responsible for preventing accidents in the gym?

Whenever you undertake strenuous physical activity such as gym workouts, there is a potential for injury, and it isn’t always the case that it is the fault of anyone in particular. However, if you suffer an injury at the gym and you believe negligence has played a role, you could be entitled to make a claim.

Under the Occupiers Liability Act 1984 in UK law, gym owners must take all reasonable measures to keep their premises safe and minimise the risk of injury - both to visitors and staff. Some of the responsibilities that this entails include:

  • Carry out risk assessments and regular maintenance
  • Ensure machinery is safe to use and used safely
  • Provide proper training to all staff members
  • Put safeguarding measures in place for groups who may be more vulnerable than others (i.e. users with disabilities)
  • Provide health and safety information to all gym users (signage, equipment instruction), etc
  • Provide all new users with induction

Where one or more of these responsibilities have been neglected – or if the gym owner has not taken other reasonable steps to ensure people’s safety – they could be liable for any accident that causes injury on their property.

Frequently asked questions

How much could I receive in gym injury compensation?

How much your claim might be worth depends largely on how serious your injuries are and how long a full recovery might be expected to take. However, in addition to damages for pain, suffering and loss of amenity, most claims include a sum to cover any loss of earnings as well as the cost of any medical treatment, physiotherapy or other necessary rehabilitation.

Is there a time limit for making a gym accident claim?

There is a time limit of three years from the date of any accident for you to start a compensation claim, though you can be allowed longer if you are claiming on behalf of a child or someone with mental impairment.

You should also bear in mind that most injury compensation claims will require evidence to be presented, so you will need to make sure you have photographs, witness statements and medical evidence available to support your claim, even if the accident occurred up to three years ago.

How long does it take to make a gym accident claim?

It can be difficult to say from the outset how long a claim may take, as there are several different factors that can influence how long the claims process takes. For example, one of the most significant factors will be how quickly the other side (i.e. the gym owner) admits responsibility for your accident. Only once this has been established can we begin to negotiate the amount of compensation owed.

Our solicitors always work hard to ensure the claims process runs as smoothly and efficiently as possible and will keep you fully informed of the progress we are making. To discuss your case in more detail, and learn how much compensation you could be owed, speak to a member of our team today.

Could I make a claim for gym injury compensation on behalf of someone else?

Yes, it is possible to make a gym injury claim on behalf of a loved one in certain circumstances.

It may be possible to do so if, for example, the person injured lacks the mental capacity to be able to make a claim for themselves, or they are under the age of 18.

Can I make a No Win No Fee gym injury claim?

The majority of our personal injury claims are funded by a conditional fee agreement, otherwise known as a No Win No Fee agreement.

This means if you lose your case, you won’t have to pay any fees and therefore, there’s no financial risk to you. You can learn more about making a No Win No Fee personal injury claim here.
