Who is liable for a package holiday claim?

If you’ve been injured on a package holiday, your package provider is liable for any accidents that occur due to their negligence.

As part of their responsibility, it is up to your package provider to ensure that the hotels in which they offer accommodations and the excursion or activity providers they work with operate safely, with your wellbeing in mind. Where these standards slip, your package holiday provider is liable for the cost of any recompense owed.

There are numerous regulations in England and Wales that ensure the process of claiming compensation against a package holiday provider is straightforward, such as the Package Travel and Linked Travel Arrangements Regulations 2018.

Can I make a claim for package holiday compensation in the UK?

Yes, if you entered into the package holiday in the UK or if the Tour Operator is based in the UK.

If your package holiday provider is based in the UK, your claim will usually be pursued here through the courts of England and Wales. If your claim cannot be pursued against the Tour Operator then you may need to advance your claim against the hotel directly, and whilst in most circumstances you can still do so through the courts of England and Wales, in some cases, you will need to pursue your claim abroad.

In either case, your solicitor will be able to advise you of the best course of action for your case, and will explain in detail the process of claiming compensation, whether in domestic courts or in foreign courts.

If you booked a package holiday in the UK, you should have up to three years from the date of the accident to begin your claim.

How much will my package holiday claim be worth?

It's very difficult to estimate how much compensation you're likely to receive for your injury until we have obtained medical evidence and collated your financial losses. The amount of compensation you may receive can differ depending on the extent of your injuries as well as the laws governing compensation claims in the relevant country. If, however, your claim is against a UK based tour operator you claim will be valued under English law.
